Abstract

Village Owned Enterprises are legal entities that have the authority to develop village wealth sources to manage village assets, services and other forms of business for the welfare of village communities, as an effort to improve the economy for the community. This study examines Village Owned Enterprises (BUMDes) which managed by the community and village government in an effort to utilize village assets in strengthening the economy for the welfare of the community, which is then further regulated in Government Regulation No. 11 of 2021 concerning Village-Owned Enterprises and Law No. 6 of 2014 concerning Villages. The issues that will be examined in this study are (1) How is the management system a success factor and inhibiting factor for BUMDes in Canga'an Village, Gresik Regency, (2) What is the juridical legal review of BUMDes Management in Villages? Canga'an Gresik Regency according to the Perspective of Siyāsah Māliyah This study aims to analyze the management of BUMDes from a Juridical and Fiqh viewpoint of Siyāsah Māliyah This type of research uses descriptive qualitative research with an empirical juridical approach that is carried out directly to find out problems that occur in the field and then connected with legal theory and statutory regulations. Sources of data to be obtained from primary and secondary data, including the results of observations or observations, interviews with BUMDes management and village government, as well as documentation The results of this study are BUMDes Taman Jaya whose business forms are market units, savings and loan units, rental and industrial units, trading units, pamsismas units, and PPOB units. Implementation of PP No. 11 of 2021 concerning BUMDes, that the BUMDes Taman Jaya Canga'an Village is related to management which is still not in accordance with what is written in the PP, so that its management experiences obstacles, as for the success factors and obstacles to the management of BUMDes Taman Jaya, namely the success factor is the professional management of BUMDes to the village community, while the inhibiting factors are in terms of funding, lack of supervision of BUMDes and community knowledge, then in Siyāsah Māliyah's view BUMDes are included in the Baitul Māl group which regulates community assets and conditions, the purpose of BUMDes is very relevant with one goal in Islamic law.
