Abstract

In an era of increasingly developing times, the film industry has also experienced an increase in filmmaking where this has an effect on the condition of the people. In protecting the film environment for society, the institution authorized to censor is the Film Censorship Institute. The results of the research show that the Censorship Institute (LSF) has the duty and authority to select the parts of a film and film advertisement that are suitable for consumption, or which parts should be cut or eliminated. To confirm the duties and authorities of the Film Censorship Institute (LSF) it is regulated in Government Regulation Number 18 of 2014 concerning Film Censorship Institutions (LSF). However, in reality, LSF has not carried out its duties and authorities properly. Because, there are several articles that still need to be addressed. This research will discuss how LSF carries out its duties and authorities according to Government Regulation Number 18 of 2014. In addition, this study will also discuss the purpose of analysis of Government Regulation Number 18 of 2014 seen through the Islamic perspective of Maqāṣid Asy-syarīʿah. This study uses qualitative normative juridical research methods (library search). This research uses primary legal materials and secondary legal materials in the process with a statute approach in order to obtain an in-depth and comprehensive understanding of the status of LSF. This analysis will combine Hans Kelsen's theory (Stufenbeu Theory) and Maqāṣid Asy-syarīʿah Theory according to Al-Syatibi's thought as the theoretical basis for this research. The results of the study show that Government Regulation Number 18 of 2014 concerning Film Censorship Institutions in filtering and determining the status of censorship of films and film advertisements is still ineffective. In addition, in terms of the theory of Maqāṣid Asy-syarīʿah, there are still many disadvantages compared to the benefits.
