Abstract

The digital cash waqf corner program is the latest innovation in the world of waqf within the Ministry of Religion. This program was officially formed in 2021 by the Ministry of Religion of Gunungkidul Regency. Several things that become problems arise such as related to the validity of the pillars and terms of waqf from the perspective of Islamic law and positive law. There fore the author analyzes related to these problems which are divided into 2 main problems. First, the implementation of this digital money waqf corner program. Second, the implementation of the digital money waqf corner program related to pillars and conditions from a Islamic law and positive law perspective. In this study the authors used several theories including the legitimacy of worship, the theory of Legal Istinbat which contains reasoning in terms of taklili and istislahi and also uses the theory of the Law on waqf. These three theories will later be used as an analytical knife for this research problem. This research is empiricial normative and uses a type of field research to obtain data sources. In implementing the digital money waqf corner program, the pillars and conditions in the waqf contract must be fulfilled perfectly as a legal condition for a waqf worship. As for the pillars of waqf, namely wakif, mauquf alaih, mauquh bih, and pledge. The statutory regulations also contain almost the same requirements for the implementation of waqf, namely waqif, waqf assets, nazhir, designation of waqf assets, waqf pledges. Based on the research that has been done, the authors obtain conclusions which show that from a Islamic law aspect the implementation of the Digital Cash Waqf Corner program has fulfilled the pillars and requirements of implementing waqf and this program has aspects of benefit for the community, especially the Gunungkidul Regency area. According to the Positive Law review, the implementation of this program has complied with and complied with predetermined rules, such as the criteria for wakif, waqf assets, cooperating nazhir, designation of waqf assets, and procedures for making pledge deeds.
