Abstract

As living beings, humans certainly have needs as a support in living their lives. Human needs are divided into three types, namely primary, secondary and tertiary needs. At present, vehicles have a major role in human economic needs, including as travel accommodation and transport of goods. The importance of vehicles in human life is directly proportional to the human need for vehicles. However, the price of vehicles is relatively expensive and difficult for some people with middle to lower incomes. As a solution to these obstacles, a social gathering practice was formed which can make it easier for the community. One example is the practice of arisan at CV Sehati, this arisan is carried out using a closed auction system and in practice there are several alleged problems such as speculation and buying and selling objects that did not exist when the auction was held. An indication of speculation in this practice comes from the lottery system which is carried out behind closed doors. Participants do not know the largest number of bids made by other participants, so participants will set the highest price with their ability to bid at the motorcycle auction. The type of research used is field research, which is descriptive-analytical qualitative. This study uses a normative-empirical approach by taking primary and secondary data sources. Primary data sources are taken by means of research through observation, interviews, and documentation. While secondary data comes from research that has been conducted at CV Sehati or narratives made by third parties on research objects. The results showed that the practice of motorcycle gathering at CV Sehati complies with the principles of Islamic law. Among them, namely the object of sale and purchase that does not exist at the time of the auction has been agreed upon by both parties and will be given after payment of the auction and other costs and the auction that is carried out is not included in the act of maisir because the speculation made when bidding for the auction does not bring harm or loss to participants. In addition, the practice of CV Sehati's motorcycle arisan is in accordance with the principle of benefit. The practice of arisan based on the principle of gotong royong is seen as an effort to bring goodness and avoid harm. The practice of arisan is also in accordance with the purpose of forming Islamic law which has five elements, namely ḥifẓ dīn, ḥifẓ nafs, ḥifẓ 'aql, ḥifẓ nasl, and ḥifẓ māl.
