Abstract

Rejected sale is one of the products that is quite widely sold on the Shopee platform, namely products that do not pass quality control or have defects so that they can be sold at low prices. Therefore, the seller must clearly explain related to the specifications and defects of the product. This is because it prevents disputes between the two parties. However, in fact there are still many sellers who do not explain the specifications and defects related to the products they sell. In this study, the author will review the practice of buying and selling rejected sales through the preview of Islamic law by using buying and selling theory and garar theory. This research is an involved research whose object of research is the practice of buying and selling rejected sales on the Shopee platform. This research uses qualitative research methods with a descriptive form of analytics. The type of research used is field research with an Islamic legal approach that uses the theory of buying and selling and garar. Data collection techniques are carried out by examining sources related to the subject matter, both primary sources in the form of observations and secondary sources obtained from literature materials. Next, the data are analyzed and conclusions are drawn. From this research, that buying and selling rejected sales is basically allowed with the condition that defects in the product must be clearly described. The rejected sale models that develop include: a) Buying and selling rejected goods by providing products with random models, colors, and defects containing garar because of the buyer's ignorance of the specifics of the goods sold. This sale and purchase is included in the sale and purchase of garar al-kas|ir. b) Buying and selling rejected goods by providing products according to the model, defects and colors according to the seller's description. This rejected sale buying and selling model is considered valid and permissible because there is no garar in it, c) Buying and selling rejected goods by providing products in accordance with existing stock. Buying and selling this model is the same as the first model contains garar because the buyer does not know the specifications of the product sold because the product is shipped according to existing stock, but the buyer can ask the seller about the available stock so that the buyer knows the specifications of the product clearly. Garar in this trade is included in garar al-yasir.
