Abstract

The law of praying for Muslim bodies is fadhu kifayah which means it is not an obligation for everyone to carry out worship which is fardhu ain. From this law, one of the cultural diversity gave birth, namely the management of corpses carried out by the people of Sengkotek Sub-District, Loa Janan Ilir District, the giving of money to some people for funeral prayers. From this background, this research will look at the sociology or the motives and purposes of giving money at the funeral prayer by the people of Sengkotek Village, detailed in two questions: why should there be money being given during the funeral prayer?; and What is the view of the sociology of Islamic law on the practice of giving money at funeral prayers in the Sengkotek Village? This research is a field research using a juridical-empirical approach. While the data analysis research method used is analytical descriptive. The data collection techniques used are interviews, observation and documentation. Based on the analysis that has been carried out by the author, the research results show that the motive, purpose or background of giving money at the funeral prayer is carried out by the Sengkotek Village community based on the sociology of Islamic law and Max Waber's theory of social action, which is more inclined to traditional actions because the giving of money is done It is hereditary and people are used to this tradition. It is also analyzed from the law of giving money at the funeral prayer that this tradition is urf valid, namely a custom that does not violate Islamic religious law. This tradition also has motives that can be analyzed with the motives of other social actions, based on the act of value rationality in the form of people's trust in the hadith narrated by Imam Muslim in the form of the primacy of the funeral prayer with a congregation of 40 people, based on the type of action of instrumental rationality in the form of calculation of dues as well as establishment pillars of death that are aligned with its goals and prioritize the benefit of the community, while in the type of affective action based on emotion, namely gratitude towards the congregation for their time to pray and pray and from the congregation's point of view there is an emotion to worship in order to get the predetermined vitures in Islam and also help Muslim brothers in praying the corpse.
