Abstract

The contract is an important instrument in buying and selling activities, contract or can be called an agreement where an act has the aim of binding someone with everything that has been agreed upon. However, there are also many actions that can injure the validity of a contract, one of which is unilateral cancellation. Several incidents of unilateral cancellation made by the buyer after the agreement was agreed. As in buying and selling batik at the Fitriss Mandiri UKM, batik based on the results of a survey that researchers have conducted at the Fitriss Batik Mandiri Outlet where unilateral cancellations occur due to several factors, namely from the business actor's point of view that unilateral cancellations are due to a mistake in mutual trust with a background of knowing each other between batik craftsmen with customers and lack of experience in terms of written agreement law and are used to ignoring contracts. This discussion will present a juridical analysis regarding the urgency of applying the istishna contract in resolving the problem of unilateral cancellation in a sale and purchase transaction at Fitriss Mandiri Batik UMKM. This type of research is field research, namely data obtained directly from field research (the community). In obtaining data the researcher conducted interviews, observation and documentation, Based on the analysis that has been done, the author concludes that the UMKM Fitriss Mandiri Batik does not apply the principle of a Sharia agreement, so the author offers an istishna contract in transactions carried out because there is often a risk of loss for batik owners due to many acts of unilateral cancellation.
