Abstract

This research discusses the position and function of Non -Muslim DPRK members in legal legislation in areas where the majority Muslim population. In the legislative elections of Southeast Aceh Regency 2019-2024, non-Muslim communities won 6 seats and the percentage rose 2 times from the previous year, this was the reason for this research was taken. This type of research is field . while the nature of this research is descriptive using data collection methods of observation, interviews, and documentation. The results showed: Non-Muslim DPRK members have the same position as members of the Muslim DPRK, this is seen in carrying out legal legislation between non -Muslims and Muslims has the same involvement of the same position and function in the involvement in voicing opinions. However, in the implementation of the right of initiative is still lacking. As for the position and function of the DPRK, when viewed from the theory of Ahl Hall Wal Aqd, the position of the DPRK in Islam, which is specifically called ahl halli wal aqd, has a broader position. The DPRK's task in common with ahl halli wal aqd is to draft laws or legal regulations for the benefit of the community, the difference is that the DPRK gives suggestions on draft laws while the ahl halli wal aqd are representatives of the people who can issue fatwas.
