Abstract

Protection and efforts to fulfill these human rights must be given to all levels of society fairly, including the rights inherent in children. Efforts to fulfill this right are very important because these children are inherently a vulnerable group. In Indonesia, efforts to fulfill children's rights are realized by creating the "Kabupaten Layak Anak (KLA)" program. In 2021, Ponorogo Regency has held the title of Kabupaten Layak Anak Pratama. However, in fact, Ponorogo Regency still faces many problems related to child protection from sexual abuse, violence, neglect, exploitation and other mistreatment. Therefore, the author is interested in examining how the feasibility of Ponorogo Regency in holding the title of Kabupaten Layak Anak. The author focuses the study in this scientific paper on two problems, how the feasibility of Kabupaten Ponorogo in holding the title of Kabupaten Layak Anak and how the Kabupaten Layak Anak program in Ponorogo District is in the perspective of maqa>s}id asy-syari>‘ah. In looking at the feasibility of Kabupaten Ponorogo in holding the title of Kabupaten Layak Anak, the author uses the theory of legal effectiveness that was coined by Soerjono Soekanto. Meanwhile, in looking at the maqa>s}id asy-syari>‘ah perspective, the author uses the maqa>s}id asy-syari>‘ah theory of Jasser Auda as the scalpel. The type of research carried out in compiling this scientific work is field research. This study uses two approaches, the normative approach and the empirical approach. The data analysis technique in this study uses qualitative analysis by describing the findings or data narrated with a normative-empirical approach. Based on the research that the author has conducted in Ponorogo Regency, it can be concluded that, first, The Ponorogo Regency Government has implemented many development programs based on children's rights. Some of the programs carried out have fulfilled the objectives that was stipulated by laws and regulations. Therefore, Ponorogo Regency deserves the title of Kabupaten Layak Anak although from the aspect of institutional strengthening, there are no regional regulations organizing the family environment and alternative care and Kawasan Tanpa Rokok (KTR). Second, The implementation of Child Decent District as a child rights-based development system has a good goal to build Human Resources. The implementation of KLA has also been carried out in accordance with contemporary maqa>s}id principles based on the fulfillment of 6 (six) system features in the perspective of Jasser Auda.
