Abstract

Protection and Management of the Environment in Law Number 11 of 2020 concerning Job Creation has not yet reaped any benefits for the environment, because in this Law there are still several articles that are controversial. The concept of the environment is related to the concept of mashlahah, because mashlahah is a means of caring for Maqăṣid asy-Syarĭʻah, which means that the environment is included in Maqăṣid Syarĭ'ah which must be preserved for living things. There are two formulation methods used in environmental fiqh, namely mashlahah and Maqăṣid asy-Syarĭʻah. Therefore this research discusses the concept of the environment in Law Number 11 of 2020 concerning Job Creation from the Maqăṣid asy-Syarĭʻah Perspective. The purpose of this research is to map and understand the Paradigm of Environmental Protection and Management in Law Number 11 of 2020 Concerning Job Creation from the Perspective of the 1945 Constitution of the Republic of Indonesia and Maqăṣid asy-Syarĭʻah. This research is a type of library research, namely research whose object uses library data in the form of books as a data source. Based on its nature, this research is descriptive analysis. The approach in this study is a Sosio Juridical approach. The materials used are Law Number 11 of 2020 concerning Job Creation, Law Number 32 of 2009 concerning Environmental Protection and Management and books related to research. Data analysis techniques were carried out by editing, clarifying, verifying, analyzing, and concluding stages. The results of the research show that, first: The paradigm for protecting and managing the environment in Law Number 11 of 2020 must consider the principles of legal certainty. In order to provide protection and a sense of justice, the legislation process for the Job Creation Law in the environmental sector should prioritize the interests of the community. Second: The Paradigm of Environmental Protection and Management from a Constitutional and Maqăṣid asy-Syarĭʻah Perspective is regulated in the state constitution, but causes damage to the social order of life which is the reason for rejection in the Maqăṣid asy-Syarĭʻah, so that environmental damage has implications for the imbalance in the existence of living things on earth.
