Abstract

In accordance with its authority, the Yogyakarta Special Region Government issued Governor Regulation No. 1 of 2021 concerning the Control of the Implementation of Expressing Opinions in Public Spaces (Pergub DIY 1/2021). Following its establishment in January 2021, the enforcement of Pergub DIY 1/2021 faced opposition from several civil society organizations under the banner of the People's Alliance for Democracy in Yogyakarta (ARDY). ARDY criticized certain articles that were deemed to undermine the protection of human rights. Furthermore, ARDY assessed that the formation of Pergub DIY 1/2021 did not involve public participation and reported the Yogyakarta Government to the Ombudsman of the Republic of Indonesia for creating the regulation. Based on this report, the Ombudsman declared maladministration in the formation of Pergub DIY 1/2021. However, up to now, the regulation has not been revised or revoked. Given these various issues, what is the legal and political analysis of the formation of Pergub DIY 1/2021? This study adopts a normative-empirical approach, collecting data through literature review and interviews. The statute approach is also used to assess the compatibility of Pergub DIY 1/2021 with other legal regulations. The research sources include primary legal materials such as legislation and secondary legal materials such as books, scholarly works, and others. The gathered legal materials are then qualitatively analyzed using deductive logic. This research concludes that Governor Regulation (Pergub) DIY 1/2021, in its formation, does not comply with the provisions of Law No. 12 of 2011 regarding the Formation of Legislation, thereby proving that the Yogyakarta Government engaged in maladministration. Furthermore, in the formation of Pergub DIY 1/2021, the Yogyakarta Government appears authoritarian. This is evidenced by the absence of public participation, making the formation of this regulation highly dependent on the government's desires based on the results of the social vision of political elites (centralistic). The lack of public participation does not align with the provisions of Minister of Home Affairs Regulation No. 80 of 2015 regarding the Formation of Local Legal Products and Yogyakarta Regional Regulation No. 2 of 2019 concerning Procedures for the Formation of Local Legal Products. This situation creates Pergub DIY 1/2021 as orthodox/conservative or elitist and open to interpretation amid its implementation in society.
