Abstract

In everyday life, humans cannot be separated from mu'a>malah activities, because every human being needs each other and one way to fulfill this is through buying and selling transactions. With the development of the times, buying and selling systems are becoming more varied, one of which is buying and selling using an honesty system as is the case at the Faculty of Sharia and Law at UIN Sunan Kalijaga Yogyakarta. In the practice of buying and selling, there is no direct meeting between the seller and the buyer when delivering the goods. This research aims to find answers to the implementation of buying and selling practices using an honesty system at the Faculty of Sharia and Law at UIN Sunan Kalijaga Yogyakarta and the skills of sellers and buyers when buying and selling contracts take place are examined using a comparison of Islamic law and civil law buying and selling contracts. This research is field research, with an empirical approach, descriptiveanalysis- comparative in nature. Primary data was obtained from interviews with sellers and buyers in the area of the Faculty of Sharia and Law at UIN Sunan Kalijaga Yogyakarta. Secondary data was obtained from books, articles, scientific works and those related to this research. Then the data obtained in the research was analyzed using the maqa>s}id syari>'ah approach. The results of this research explain that in the practice of buying and selling at the Faculty of Sharia and Law, if examined using contracts in Islamic law, 'A>qid (seller and buyer) are both sensible people, not children, crazy people or stupid people. and already mature. In civil law, both parties are adults who are fit and proper to enter into a contract and are responsible for what they do and are over 21 years old. The seller and five buyers who became informants are honest and capable of taking responsibility for their actions. If analyzed using the maqa>s}id sharia>'ah theory, it brings benefits such as practicing honesty, more time efficiency, buying and selling empowers many people such as home industry mothers, resellers in various places so that the business brings benefits not only to themselves. but also the people around him. However, it also brings harm, such as lack of supervision, making it vulnerable to loss of food and money. Overall, this buying and selling brings benefits because the seller has resellers and other businesses apart from those at the Faculty so that when there is a loss of food he intends to make sadaqah and make a profit from his blessings.
