Abstract

The principles of state policy (PPHN) are planned to be re-implemented by the people’s consultative assembly (MPR) with the aim of replacing law number 25 of 2004 concerning the national development planning system (SPPN), with law number 17 of 2007 concerning development plans national long term 2005-2025 as the national development planning guidelines currently in effect. The national development planning system (RPJPN) and the national long term development plan for 2005-2025 are considered no longer to meet development needs in indonesia. The method taken so that the principles of state policy (PPHN) can be re-implemented in the indonesian constitutional system is by adding the authority of the people’s consutative assembly (MPR) in article 3 of the 1945 constitutional (UUD) his leadership period was guided by PPHN. This type of reseearch is library research which is descriptive-analytic in nature wich a juridical-normative approach. Data collection was carried out using literature studies through searching and reviewing legal materials in the form of books, scientific, journals, legal and regulatory document, and so on data sources consist of primary data in the form of statutory regulations, and secondary data obtained from books/jounals/other scienific articles, then analyzed using qualitative analysis. The results of this research are, first, bringing back state policy in the form of state policy principles (PPHN) is a very important thing to do because: (a) state policy principles (PPHN) have an important, strategic and fundamental position, and (b) the national long-term program design paradigma (RPJPN) which is very executive centric, and according to the basic principles of benefit, namely that there are principles that have been fulfilled and there are principles that have not been fulfilled, the principles that have been fulfilled are the principles that are still being gradually established in the law, while the principles that have not been fulfilled are the principles that still narrow the law-making process, the principles that provide convenience and relief, and the principle that the enactment of laws follows the benefit have not been fulfilled regarding policies in enacting laws related to the principles of state policy.
