Abstract

In terms, childfree is a decision and agreement between husband and wife not to have children for reasons such as economics, trauma, or other reasons. In relation to childfree, the MUI only touched on the issue of limiting offspring according to the results of the trial in 1979-2012. This article analyzes two different views of the Yogyakarta Special Region MUI ulama towards childfree. This type of research is (field research). The approach used is maqāṣid al-syarīʿah. The analytical method used is qualitative by displaying data in the form of descriptive analytical data from Maqāṣid al-syarīʿah Jaser Auda in analyzing the views of the Yogyakarta Special Region MUI ulama towards childfree. Data collection techniques were through interviews with the purposive sampling method. The research results show that the views of the Yogyakarta Special Region MUI ulama consist of three (3) views. Firstly, childfree violates the substance of marriage. Second, childfree preservation of vasectomy and tubectomy. Third, childfree comes from western culture or westernization. Then in Jaseer Auda's maqāṣid al-syarīʿah maintaining offspring (an-nasl) is included in the dimension of necessity (daruriyyat) which is not in accordance with childfree.
