Abstract

YouTube, as one of the works protected by copyright, often experiences copyright violations in the form of re-uploading videos by other creators. This reuploading can enhance recognition and audience reach but also raises copyrightrelated issues. Awareness of the importance of respecting copyright becomes crucial to create a fair and sustainable digital environment for content creators on YouTube. The issue at hand involves the re-uploading of videos by others, which is the copyright of the content creator through YouTube, and this action potentially constitutes a copyright violation based on Law Number 28 of 2014. In this context, the formulated problems are as follows: (1) Is re-uploading video content via YouTube a copyright violation based on Law Number 28 of 2014? (2) What are the efforts to resolve copyright infringement losses due to re-uploading of video content carried out by violators? This research is a normative legal study that is descriptive-analytical with a statutory approach and a normative approach. Data collection techniques involve qualitative data collection, and data analysis employs qualitative data analysis. The results of this research indicate that, this action violates YouTube policies and also breaches Law Number 28 of 2014 Article 8, stating that economic rights are the exclusive rights of creators or copyright holders to obtain economic benefits from their work. In an effort to resolve the damages caused by copyright violations in the re-uploading of video content by other content creators, the owner of the Raga79 YouTube account can negotiate with the violator on their YouTube account. This negotiation aims to reach an agreement on royalty payments and compensation to the content owner. This resolution effort is based on the damages incurred by the content owner, both materially and nonmaterially. Material damages include changes in income that should have been received by the content owner, while non-material damages involve changes in the algorithm on the Raga79 YouTube account and a decline in viewer numbers and stability.
