Abstract

The justice system in Indonesia has experienced rapid development, one of which is that virtual or electronic mediation has begun to be implemented in Indonesia, including at the Bantul Religious Court. With the issuance of a new regulation, namely PERMA Number 3 of 2022 concerning Electronic Mediation in Court, this has become a benchmark for the implementation of electronic mediation. Due to the new regulations, it is possible that there are still many people who don't even know about electronic mediation, especially about the implementation process. Therefore, researchers want to dig deeper into the implementation of electronic mediation and the effectiveness of its implementation in the view of mediators at the Bantul Religious Court, as well as its conformity with relevant regulations, namely PERMA Number 3 of 2022. This research uses a qualitative field research method with an empirical juridical approach where this research examines the enactment or implementation of normative legal provisions directly in each specific legal event that occurs in society. In this case the research was carried out at the Bantul Religious Court as the research sample. For data collection techniques in this research using interviews and documentation. In this research, it can be seen that the implementation of electronic mediation at the Bantul Religious Court still emphasizes hybrid mediation because the signing of the peace deed is still done manually. Apart from that, the implementation of electronic mediation at the Bantul Religious Court has been carried out well and in accordance with applicable provisions, namely PERMA Number 3 of 2022, starting from pre-mediation to conclusion. However, in practice, there are several obstacles such as a slightly unstable network and electronic mediation is not completely effective in uniting the two parties to the dispute.
