Abstract

Polygamy is one of the Islamic laws that is permitted with the conditions and reasons that have been determined. One of them is by fulfilling the requirements that the husband is able to guarantee the needs of his children and wife as seen from their financial capabilities. In 2022 at the Bantul Religious Court there was an application for a polygamy permit with case number 1085/Pdt.G/2022/PA.Btl and case number 1373/Pdt.G/2022/PA.Btl, both of which contained the application for a polygamy permit because it met the capacity requirements husband's finances, even though their financial capabilities are different. The author's main problem regarding this research is whether the decision is in accordance with existing regulations, then how the judge considers financial capacity as a basis for submitting requirements for a polygamy permit, and how the judge considers it in decision number 1085/Pdt.G/2022/PA.Btl and number 1373/Pdt.G/2022/PA.Btl in perspectivemaslahah mursalah. This type of research is library research with a juridical-normative approach. Meanwhile, the data analysis method used is descriptive analytical. In the data collection method, the authors used interview, observation and documentation methods. Based on the research results, it is explained that (1) The judge's consideration of financial capacity as a basis for submitting polygamy permit requirements in the Bantul Religious Court Decision Number 1085/Pdt.G//2022/PA.Btl and Number 1373/Pdt.G/2022/PA.Btl based on the considerations contained therein, that the judge's considerations in the decision are in accordance with the fulfillment of the facultative and cumulative requirements. As for the financial capacity requirements, there is no minimum limit for a husband's income or financial benchmarks for obtaining a polygamy permit. If there are circumstances that allow the husband to remarry then the financial capacity requirement is set aside because it is not the main requirement. (2) The Judge's considerations in the Decision of the Bantul Religious Court Number 1085/Pdt.G/2022/PA.Btl and number 1373/Pdt.G/2022/PA.Btl are in accordance with the theorymaslahah mursalah because it is in harmony with important elementsmaslahah mursalah, that is, preventing evil takes precedence over bringing about good. These two decisions granted the request for permission for polygamy to prevent the damage that arises, namely adultery, which is haram.
