Abstract

The international economic turmoil has influenced Indonesia's economy in various aspects. One aspect impacted by global economic instability is the industry. Many companies in Indonesia have resorted to layoffs and even faced bankruptcy. The government, through the Ministry of Manpower, seeks to provide a solution by enacting Peraturan Menteri Ketenagakerjaan No. 5 of 2023 concerning Adjustment of Working Hours and Wages in Certain Labor-Intensive Export-Oriented Industries Affected by Global Economic Changes. However, there is a clause regulating the adjustment of working hours and wages, leading to some workers rejecting the government's proposed solution through Permenaker 5/2023, deeming it detrimental to them. In this study, the author will review the fulfillment of workers' rights to wages under Permenaker 5/2023 through a sociological and philosophical preview, using legal sociology and Maqāṣid asy-syarī`ah (objectives of Islamic law) theories. This research focuses on analyzing Permenaker 5/2023. It utilizes a qualitative research method with a descriptive-analytical approach, employing a literature review with sociological and philosophical perspectives, utilizing legal sociology and Maqāṣid asy-syarī`ah theories. Data collection involves examining sources related to the issue, including laws, books, journals, and other literature materials. Subsequently, the data is analyzed and conclusions are drawn. Based on the research on Permenaker 5/2023, it can be understood that the adjustment of working hours and wages for workers is a suitable solution for both workers and employers. Sociologically, the social origins and motives behind Permenaker 5/2023 stem from stakeholder roles, balancing interests, worker protection, and ensuing social impacts. Additionally, there are three forces with their respective interests that make Permenaker 5/2023 a reservoir of conflicting interests and powers within society. These forces include the government aiming to maintain economic stability, employers seeking to sustain businesses for profit, and workers striving for wages to sustain their livelihoods. Philosophical analysis based on maqāṣid asy-syarī`ah theory reveals that the concept of "hifdzu al-maal" (preservation of wealth) in Permenaker 5/2023 materializes through clauses safeguarding worker welfare, balancing wage regulations, avoiding economic losses, and promoting general well-being. Thus, it can be concluded that Permenaker 5/2023 provides benefits to all involved parties.
