Abstract

Online motorcycle taxis are a transportation service that is in demand by many people in Indonesia. Several advantages such as flexibility, price certainty and timeliness are attractive so that many conventional motorcycle taxi consumers switch to online motorcycle taxis. Along with the increasing growth of online motorcycle taxi consumers, people's interest in becoming drivers is also increasing, which has implications for becoming increasingly tighter. According to economists, business competition can basically have a positive impact if it is carried out with healthy competition. Business competition between drivers can basically have a positive impact if it is carried out with healthy competition. However, the reality on the ground shows that there is a practice of using additional fake GPS applications. Some drivers use fake GPS applications to get orders and bonuses more quickly. Referring to the 2008 Electronic Information and Transactions Law, using fake GPS is one of the prohibited actions. However, the practice of fake GPS still continues. This type of research is field research with a sociological juridical approach. Data collection techniques using interviews, observation, questionnaires and documentation. The analysis of this research data is inductive-qualitative, then the analysis is carried out using a theoretical framework, namely law enforcement theory. The results of this research show that there are 3 main factors behind the practice of using fake GPS by online motorcycle taxi drivers, namely economic factors, law enforcement factors by the company system, and ease of getting orders. The model for using fake GPS can be done in various ways. The method for obtaining a fake GPS application can be through 3 media, namely through telegram groups, through friends, and creating your own. The impacts caused by using fake GPS are divided into 2, namely positive impacts and negative impacts. The positive impacts are felt by fake GPS users because the application has advantages that can provide benefits to its users. Meanwhile, the negative impacts experienced by non-users of fake GPS, losses experienced by drivers who are non-users of fake GPS are in the form of material losses and immaterial losses. According to the view of Islamic law, the use of fake GPS applications is included in the category of prohibited acts, this is because the use of fake GPS is not in accordance with Islamic values and norms, so the use of fake GPS applications can potentially cause sin. If analyzed using law enforcement theory, namely 5 legal supporting factors, first legal factors, second community factors, third cultural factors, fourth facilities and facilities factors, fifth law enforcement factors, So it can be seen that this aspect of law enforcement needs to be evaluated and improved so that law enforcement can run effectively.
