Abstract

The upheaval of the international economy and the rise and fall of world oil prices affect the state of the Indonesian economy. One of the factors affecting the instability of the national economy is the increase in fuel oil prices. The increase in fuel oil prices affects many things, such as pressure on the budget deficit, inflation, macroeconomic stability, and also the impact on poverty. The government through coordination between the President, the Ministry of Energy and Mineral Resources, and the Ministry of Finance tried to provide a solution by increasing the fuel subsidy budget through the decision of Presidential Regulation Number 98 of 2022 concerning Amendments to Presidential Regulation Number 104 of 2021 concerning Details of the State Budget for Fiscal Year 2022. However, there is a clause that regulates the adjustment of the state budget. So that some people refuse because they think that the solution offered by the Government through Presidential Regulation Number 98 of 2022 is detrimental to them. In this research, the author will review the 2022 fuel price increase policy through juridical and philosophical previews by using the welfare state theory and Jasser Auda's maqāṣid asy-syarī`ah theory. This research is a study whose object of research is Government Policy on the increase in fuel oil prices in 2022. This research uses qualitative research methods with an analytical descriptive form. The type of research used is library research with a juridical and philosophical approach that uses the theory of the welfare state and maqāṣid asy-syarī`ah Jasser Auda. Data collection techniques are carried out by examining sources related to the subject matter in the form of laws, books, journals, and other library materials. Furthermore, the data is analyzed and conclusions are drawn. Based on research on Government Policy in the 2022 fuel oil price increase, it can be understood that adjusting fuel oil prices is the right solution for the community. In terms of the Welfare State, the motive for the 2022 fuel price increase policy is the state's effort to maintain the welfare of the people and reduce social inequality by emphasizing the state's role in providing social security, reducing poverty, and providing subsidies for basic social services. The results of the philosophical analysis based on Jasser Auda's maqāṣid asy-syarī`ah reveal that the concept of hifdzu al-maal/human development in the government's policy on fuel price increases is realized through the clauses on the protection of public welfare, the provision of social security, the avoidance of economic losses, and social justice. So that the 2022 fuel oil price increase policy provides benefits to all parties involved.
