Abstract

The demands of people who want convenience in financial services make financial service business actors continue to innovate from conventional transactions to digital transactions. This advancement in financial technology has changed the financing system that was originally done face-to-face can now be done with remote transactions and can be done in a short time. P2P Lending is one that is in great demand by the public. This does not rule out the possibility of unwanted risks in the financing process. Such as consumer protection that is often ignored by the organizers and risk mitigation that has no separate regulation. This study aims to determine consumer protection in iGrow services and how to mitigate the risks of iGrow organizers in the services of PT. iGrow Resources Indonesia. The type of research used is field research (field Research). The type of approach used is qualitative with descriptive methods. The research data source uses primary. Data collection techniques using interviews. The data analysis method uses Miles and Huberman with data reduction, data presentation and data conclusion. The results of this study indicate that first, iGrow services to protect consumers from default have not shown their seriousness in protecting investor funds by working with PT Simas Insurtech Insurance. The insurance premiums paid by consumers show the lack of seriousness of iGrow in protecting consumers. Therefore, it cannot be considered as a consumer protection effort by PT iGrow. Secondly, iGrow's step in cooperating with PT Asuransi Simas Insurtech is a good action to protect lenders from the risk of default. This shows that iGrow is helping consumers and not including mitigating risk when default occurs. In accordance with the Financial Services Authority Regulation Number 10/POJK/05/2022 on Information Technology-Based Joint Funding Services, iGrow is incomplete to facilitate risk mitigation for investors. Third, in the implementation of iGrow there are still elements that harm investors, consumer protection is not in accordance with Islamic law according to the sociology of Islamic law. The loss in question occurs when the principal capital cannot be returned in full. iGrow also does not fulfill the rules in surah An Nisa 29 because its bargaining position is higher than the investor. This verse عن تراض منكم demands an equal position between the two parties involved in the transaction.
