Abstract

The Madura-owned grocery store in Sleman Yogyakarta has a unique profit-sharing system and working hours system. Madurese grocery stores apply a profit-sharing system with an oral agreement and the percentage is uncertain because it is adjusted to the net income in each month, besides that Madurese grocery stores are also never closed for 24 hours, so shop managers must be ready to work for 12 hours alternately. This is what then becomes the author's concern to examine more deeply the profit-sharing system of Madura grocery stores in terms of sharia economic law, especially in the muḍarabah contract. This research uses a type of field research (field research) which is descriptive qualitative. Data collection techniques were carried out by means of observation, interviews, and documentation, while data analysis techniques were carried out by means of data reduction, data presentation, and conclusion drawing. The results showed that the profit-sharing mechanism applied in Madura grocery stores is an oral agreement and agreement between the manager and the capital owner. The work system applied in Madura grocery stores is 24 hours without closing. Madurese shop owners usually employ two employees to share the work portion. However, the schedule is not always based on time to time, sometimes managers share time according to their respective tired portions without any particular reference. The implementation of the profit-sharing system in the management of the grocery store is in accordance with the contract that has been determined in fiqh, namely the muḍarabah muqayyadah contract, but there are several things that need to be taken seriously in the implementation of profit-sharing, namely working hours that exceed the limit. This is a serious concern because Indonesia as a country of law has set working hours at 8 hours in 1 day or 40 hours in 5 working days.
