Abstract

The emergence of Peer to Peer Lending based Financial Technology (FinTech) services procedurally offers faster and easier access without the need to visit banks or credit service offices. However, there are drawbacks such as service providers operating without proper authorization, the possibility of default risks from fund recipients, and legal status risks for unlicensed OJK services. Thus, there are two main issues addressed: First, the legal consequences of relationships in unlicensed OJK Peer to Peer Lending-based FinTech. Second, the legal protection efforts that can be undertaken by parties involved in unlicensed OJK Peer to Peer Lending-based FinTech in the Yogyakarta region. This research employs a normative empirical legal research method using literature studies that examine the theory of contractual legal relationships, legal protection theory, and consumer protection theory, utilizing a legislative regulation approach. The research data sources include primary legal materials such as laws and regulations, secondary legal materials like interviews, books, articles, and scholarly works, and tertiary legal materials from encyclopedias or internet sources. The results of this research indicate that, the existence of the Civil Code (KUH Perdata) cannot be disregarded by parties involved in bilateral agreements between fund providers and recipients in unlicensed OJK Peer to Peer Lending based FinTech. Based on Article 1320 of the Civil Code, agreements in such cases are deemed invalid. The requirements of capacity and a legitimate cause are not fulfilled because the services provided by the providers are not registered and do not have authorization from OJK, as stipulated in OJK Regulation No. 10/POJK.05/2022 concerning Information Technology-based Joint Funding Services. Legal protection that can be undertaken by parties involved in unlicensed OJK Peer-to-Peer Lending-based FinTech includes preventive legal protection through understanding industry risks and opportunities through financial literacy education and financial inclusion, aiding consumers in understanding potential financial, legal, and privacy risks. Repressive legal protection is through the issuance of Law No. 4 of 2023 concerning the Development and Strengthening of the Financial Sector, serving as the basis for OJK to enforce criminal sanctions against unlicensed financial service business operators, and the Financial Services Authority Regulation No. 22 of 2023 concerning Consumer and Public Protection in the Financial Services Sector, strengthening OJK's authority in civil lawsuits.
