Abstract

The issue regarding applications for polygamy permits in Indonesia is now beginning to vary. One of them is polygamy on the grounds of a wife who is unable to meet her husband's biological needs. The judge analyzed the inability of the wife to serve the husband's biological relationship with the wife's inability to fulfill her obligations as a wife. As happened in the decision of the Karanganyar Religious Court Number 803/Pdt.G/2023/PA.Kra where the judge granted the application for polygamy permission for polygamy because he had a high sexual desire without seeing any evidence of testimony from expert opinion, seeing high sexual desire in the medical world is a curable disease. The decision attracted the attention of the author to examine more deeply using the theory of the actori incumbit probatio and maslahah mursalah. This study is a qualitative study with a type of research, namely library research that is descriptive qualitative. Authors use a juridical-normative approach, as well as deductive data analysis. The primary data source used by the author is the Decree of the Karanganyar Religious Court Number 803/Pdt.G/2023/PA.Kra, books, scientific writings, and other sources that support research. In order to support primary data, the author uses secondary data in the form of interviews to the chairman of the assembly who gave the decision number 803/Pdt.G/203/PA.Kra. After conducting the research, it can be seen that in the Decree of the Karanganyar Religious Court 803/Pdt.G/203/PA.Kra, under the burden of proof that the applicant's argument does not conform to the principle of actori implicit probatio in which the applicant does not attach a certificate that the applicant is proven to have a high sexual desire. According to maslahah mursalah, the judge's consideration on case number 803/Pdt.G/2023/PA. Kra in terms of level is included in maslahah tahsiniyah (tersier).
