Abstract

This research departs from the use of the elsimil application as a means to tackle the high number of stunting cases in Indonesia. The elsimil application is used by prospective brides who will build a new family. The family as the smallest institution in society is the main key in overcoming the stunting phenomenon. In Indonesia, stunting is currently being discussed everywhere. Achieving Indonesia's golden generation 2045 starts with having children who grow properly. While Human Resources (HR) in Indonesia still need to be improved. Because stunting itself is not a simple thing. Children at risk of stunting can affect family resilience. Due to the complex issue of stunting, not all families are ready to deal with this problem. The elsimil application is considered necessary to overcome stunting. Through the KUA, the elsimil certificate is used as a condition for marriage registration. Departing from this, this research wants to see the discourse of family law represented in dealing with stunting and how this discourse is constructed in the conditions of marriage registration. To answer this question, this study uses the theory of maqāṣid sharī'ah which is divided into three dimensions, namely ḥifẓ an-nafs and ḥifẓ an-nasl. As well as ḥifẓ ad- daulah as a new theory in revealing maqāṣid sharī'ah. This research is a field research and supported by library research. Using primary data in the form of interviews with various parties related to the elsimil application and secondary data in the form of family law books and some related literature. This research found that the purpose of lawmakers must want benefit and avoid kemafsadatan. The application of elsimil as a form of government intervention to overcome stunting in Indonesia is a form of application of ḥifẓ an-nasl. Family law preserves children from various possibilities that are not good for their lives.
