Abstract

The wages of the fundraising committee for the construction of the Syaikhona Moh Kholil al-Hikmah Mosque in Bangkalan Regency highlight the important role of the committee as a fundraiser for the construction of the mosque. The wages of the fundraising committee distinguish between permanent committee and volunteers. The question arises regarding the suitability of wages with appropriate wage requirements in sharia economic law and 'urf that applies in the community. The variety of wages and the custom of giving rewards raises questions about the validity of the fundraising committee's wages as a custom that can be used as a legal basis in the community. This research uses field research methods to analyze the wages of the mosque construction fundraising committee through the perspective of sharia economic law and 'urf. Data were collected through observation, interviews, and documentation, then analyzed using qualitative analysis techniques. Normative and empirical legal approaches are applied by considering the principles of fiqh muamalah and Islamic legal data sources. The theoretical framework of this research is based on the ija>rah contract, ju'a>lah contract and 'urf. The results showed that the wages of the fundraising committee for the construction of the Syaikhona Moh Kholil al-Hikmah Mosque are generally in accordance with the concepts of ija>rah and ju'a>lah in the aspect of the occurrence of the contract, but there are several aspects that are not fully in line with the principles of justice in fiqh muamalah, namely the nominal wages given. The 'urf perspective shows a discrepancy in terms of general recognition in society. To overcome this, it is necessary to make wages more transparent by involving the community in the management of funds. The formulation of wages also needs to be based on the principles of justice and welfare to ensure that all parties feel fair and fulfilled in fundraising activities.
