Abstract

Child marriage is a phenomenon currently receiving special attention from the Sleman District Government. The incidence of child marriage has been increasing over the years, with the highest rate recorded in 2021 in Sleman District compared to other districts in the Special Region of Yogyakarta. In efforts to prevent this, the Regent of Sleman has issued Regulation No. 31 of 2019 concerning the Prevention of Child Marriage, which regulates efforts to prevent child marriage for every department within Sleman District. The Family Learning Center (Puspaga) is one of the institutions designated under this regulation to succeed in preventing child marriage through education and consultation for those seeking solutions to address child marriage in various educational institutions and community organizations. This research aims to uncover what Puspaga has done in preventing child marriage, assess the effectiveness of Puspaga's role, and evaluate the urgency of preventing child marriage by Puspaga from the perspective of maqāṣid asy-syarī’ah. This research is based on qualitative research with a field study approach using a juridical-empirical approach. In representing the facts in the field, the author uses descriptive-analytical studies by combining data collection techniques such as interviews and documentation. Furthermore, in analyzing the facts found, the author uses legal effectiveness theory and maqāṣid asy-syarī’ah theory, which are then written based on deductive methods. The results of the study reveal that the implementation of child marriage prevention by Puspaga in Sleman District has not been fully effective due to the lack of fulfillment of several legal effectiveness parameters, especially in legal aspects and infrastructure, particularly in the societal and cultural aspects. The Sleman community lacks a good understanding of the urgency of preventing child marriage, exacerbated by a culture that tends to neglect free association. Meanwhile, from a maqāṣid asy-syarī’ah perspective, Puspaga's role in preventing child marriage is classified as a necessity (ḍaruriyyah) because it directly intersects with the preservation of life and posterity.
