Abstract

The guarantee of legal certainty as an emergency contact on online loans or P2P Lending experiences a normative gap with existing empirical facts. One of the main causes of this is due to ambiguous regulations and non-optimal law enforcement. On the other hand, business entities as actors involved still ignore personal data protection in their activities. This has an impact on the exploitation and misuse of personal data including emergency contacts by irresponsible parties. The occurrence of this nomenon then affects the flow and development of regulations which in their implementation are expected to meet expectations of compliance and awareness of privacy rights, namely through the Circular Letter of Otoritas Jasa Keuangan Number 19/SEOJK.06/2023 concerning the Implementation of Information Technology-Based Joint Funding Services. So that this research raises two (2) problem formulations, first, How is the legal protection for victims of personal data misuse involved as emergency contacts in accordance with applicable regulations. Second, How is the analysis of the legal certainty of emergency contacts on online loans in the aspect of privacy rights after the regulation of the Financial Services Authority Circular Letter Number 19 of 2023 concerning the Implementation of Information Technology-Based Joint Funding Services. This research uses a combined normative and empirical juridical method by examining the theory of legal protection, agreements, and privacy rights. The types of preparation used are interviews, literature studies, and documentation. The drafting approach used is the statutory approach (statue approach). Legislation and administrative regulations as primary materials, interviews and literature such as books, articles, journals and scientific works as secondary materials, while dictionaries as tertiary materials. The results of this study show that, first, legal protection for victims of personal data misuse is in the form of civil legal protection in accordance with Article 64 of Law Number 27 of 2022 concerning PDP, administrative legal protection namely OJK regulation Number 10 of 2022 concerning LPBBTI, and criminal legal protection in accordance with Article 67 of Law Number 27 concerning Personal Data Protection. Second, the legal certainty of emergency contact on online loans has not been optimized even though the Financial Services Authority Circular Letter Number 19 of 2023 concerning the Implementation of LPBBTI has been established.
