Abstract

This thesis examines the phenomenon of the shifting tradition of mepahukh in the marriages of the Alas tribe in Southeast Aceh. Interestingly, in conducting marriages, the Alas tribe has unique customs and procedures performed before the wedding reception, known as mepahukh. However, with the progression of an increasingly modern era, the tradition of mepahukh in Alas tribal marriages has experienced shifts. Based on this, the research aims to understand why the tradition of mepahukh in Alas tribal marriages has shifted using phenomenology theory, and how the practice of the mepahukh tradition in Alas tribe marriages is currently conducted using the theory of reception in contario. This research is a field study. To answer the research questions, the author employs a legal anthropology approach using Alfred Schutz's phenomenology theory and Sayuti Thalib's reception in contario theory. The author analyzes how Islamic law perceives the shifts occurring in the introduction process (ta’aruf) within the mepahukh tradition. This thesis uses a qualitative method, and for primary data collection, the author conducted observations and interviews. Secondary data was obtained from various other sources to complement the research needs. The research was conducted among the Alas tribe in Southeast Aceh. This study reveals that the phenomenon of the shift in the mepahukh tradition in Alas tribal marriages is caused by because motives and in order to motives that drive the shifts. The because motives include: the advancement of time and technology and the diminishing understanding of customs. The in order to motives, which are the objectives of the shifts in the mepahukh tradition, include: seeking more practical means and drinking tuak (palm wine) before the mepahukh tradition. The practice of the mepahukh tradition in the current Alas tribal marriages, after experiencing a shift from the values in the implementation of the mepahukh tradition, no longer aligns with the concept of maslahah (public interest), as the practices in the mepahukh tradition
