Abstract

During the pandemic outbreak in Indonesia, the number of early marriages in Indonesia increased drastically. This increase in cases has caused the number of applications for marriage dispensation to also increase rapidly. One of the areas with the highest cases of early marriage and the most requests for dispensation is Praya City, Central Lombok Regency. This thesis aims to determine the phenomenon of early marriage in Praya City as well as an overview of applications for marriage dispensation at the Praya Religious Court. Apart from that, this thesis also discusses the factors that cause the increase in cases of early marriage and the increase in the number of applications for marriage dispensation at the Praya Religious Court. Also, in this thesis the author analyzes the judge's considerations in giving decisions regarding marriage dispensations at the Praya Religious Court in 2020. In this research, the authors used field research methods, namely by going directly into the field to obtain data related to cases of early marriage and marriage dispensation rates at the Praya Religious Court. This research uses qualitative research with an empirical juridical approach. And the nature of the research in this thesis is descriptive analysis, where the aim of the nature of this research is to describe the research results obtained such as the phenomenon of early marriage in Lombok, the factors that cause the increase in the rate of early marriage, as well as the judge's considerations in giving marriage dispensation decisions. The data collection techniques used by the authors were observation, interviews, documentation and literature study. The conclusions of the research conducted by the authors are, first, the phenomenon of early marriage in Praya City, Central Lombok Regency is motivated by the Merariq tradition which is still strongly embedded in Sasak society where in the language, early marriage is called Merariq Kodeq, namely marriage between a man and a man. women who are still children (not yet adults). This has resulted in cases of applications for marriage dispensation at the Praya Religious Court also increasing, especially during the pandemic. Second, among the factors causing the high rate of early marriage in Lombok is the Covid-19 pandemic, parents' education and economic conditions, community culture, social media, parental supervision, as well as changes in regulations regarding the minimum age for marriage. Third, the reasons or things that the judge considers in giving a decision regarding the application for marriage dispensation at the Praya Religious Court are by referring to three things, namely administrative completeness, benefit and benefit for the child's life, and the readiness of both parties.
