Abstract

Pawning is still widely used by the public because the process is fast, easy and simple. Execution of the pledged collateral object is within the authority of the pledgee if the pledgor commits a default. PT Pegadaian has the authority to carry out executions in the form of auctions of collateral objects which are executed without going through court. However, sometimes problems arise if the debtor or pawnbroker pawns items that do not belong to him. The purpose of writing this thesis is to explain the execution of pawn collateral objects belonging to third parties due to a default at Pegadaian Lempuyangan Branch and the legal consequences arising from the execution of pledge collateral objects belonging to third parties due to default at Pegadaian Lempuyangan Branch. This type of research is field research (field research) which was carried out at PT Pegadaian Lempuyangan, Yogyakarta. This research is descriptive-analytical research, namely describing the data and analyzing the data that has been obtained using a juridical-empirical approach to see whether it is in accordance with applicable legal regulations. Data analysis or research results use agreement theory, guarantee theory, and default theory. The results of this research, Firstly, the execution of collateral objects at PT Pegadaian Lempuyangan uses an auction, if a third party as the original owner of the goods based on valid evidence makes a protest before the auction is held then the auction will be canceled and the collateral items will be confiscated to be used as evidence. Second, the legal consequences arising from the execution of the object of collateral belonging to a third party due to default at Pegadaian Lempuyangan Branch are that the agreement can be declared null and void due to the failure to fulfill the objective conditions, namely the legal conditions of the agreement in the form of a certain thing and/or a lawful cause
