Abstract

Alternate Universe (AU) works is a fiction stories created by creator using characters from Korean boyband members or celebrities, altering their names, jobs, backgrounds according to the creator's imagination to invite readers, including digital written works. Copyrighted works are regulated by Article 40 of Law Number 28 of 2014 concerning Copyrights, which includes works of science, literature, and art. One of the copyrighted works in the literary field is Alternate Universe. According to Article 40, paragraph (1) letter a of Law Number 28 of 2014 concerning Copyrights, Alternate Universe works are included in the protected creations such as books, pamphlets, the appearance of published written works, and all other written work results. This study aims to examine and analyzes the legal protection of copyright for Alternate Universe (AU) works on the Twitter social media platform based on Law Number 28 of 2014 concerning Copyrights and the legal consequences that occur in case of moral rights violations in Alternate Universe (AU) works according to Law Number 28 of 2014 concerning Copyrights. The type of research in this thesis is library research with a normative juridical approach. The normative juridicial approach is a research method conducted by analyzing the substance of legal regulations on the main issue of whether it is in accordance with existing legal principles. The legal materials used for this thesis uses library methods and questions to creators of Alternate Universe (AU) works. The results of this study are as follows: first, legal protection and recognition of written works as intellectual property are guaranteed in Article 40 paragraph (1) letter a of Law Number 28 of 2014 concerning Copyrights. However, after further analysis, regulations regarding legal protection of digital writing works, especially Alternate Universe (AU) works, have not been clearly regulated. Second, violations of moral rights can be subject to criminal sanctions according to Article 112 of Law Number 28 of 2014 concerning Copyrights. Other forms of sanctions can also take the form of court proceedings for dismissal of violations, orders for apology, orders for rectification of reputation, and takedown of uploaded works. Violations of economic rights can be subject to criminal sanctions according to Article 113 paragraphs (3) and (4) of Law Number 28 of 2014 concerning Copyrights. There are preventive and repressive legal protections that can be applied as efforts to protect the legal rights of a creation in case of copyright infringement.
