Abstract

Religious courts are judicial authorities to enforce the law for Muslim justice seekers. However, to uphold justice in resolving disputes, costs are required in the court process. The economic limitations experienced by the Indonesian people are an obstacle for the poor to access justice. From this problem, the Supreme Court issued Circular Letter Number 10 of 2010 concerning Guidelines for the Provision of Legal Aid as an effort for the underprivileged to obtain legal protection and access to justice. In 2022, the Sleman Religious Court Posbakum provided legal aid services to 1782 people based on gender, 1180 women and 602 men. This study aims to determine the factors causing people to use Posbakum for divorce lawsuits and to review the sociology of Islamic law against the factors causing people to use Posbakum for divorce lawsuits at the Sleman Religious Court in 2022. This type of research is field research with an Islamic legal sociology approach, the nature of the research uses descriptive analytic, namely describing the factors causing the parties to use Posbakum in divorce lawsuits so that they can be analyzed with the sociology of Islamic law. The data analysis method uses qualitative. The data collection method uses observation, interview, and documentation methods. Based on the research results from the review of Islamic legal sociology on the implementation of legal aid posts (Posbakum) in divorce cases at the Sleman Religious Court, it was found that (1) There are 3 factors causing people to use Posbakum in divorce cases, namely economic factors, minimal knowledge factors and limited access factors. (2) Analysis of Islamic legal sociology on the factors causing people to use Posbakum in divorce cases, namely there are still obstacles in providing legal aid so that Posbakum services reach their maximum usage limit
