Abstract

The childfree phenomenon is a phenomenon for someone who has a principle of not having children. The reasons someone decides not to have children are usually due to busy schedules with work, education, and wanting to enjoy more time with their partner. However, in Indonesia, being childfree is still a minority. Indonesian society still highly values the religion, cultural and traditional belief that children are the most beautiful blessing and a source of happiness for parents. This research aims to provide an overview of the views of the National Population and Family Planning Board of the Special Region of Yogyakarta regarding the childfree phenomenon and to review the sociology of law and maqāṣid syarī’ah related to the views of the National Population and Family Planning Board of the Special Region of Yogyakarta regarding the childfree phenomenon. This type of research is field research with a sociological-empirical approach. The nature of the research involves descriptive analysis, which describes the views of the National Population and Family Planning Board of the Special Region of Yogyakarta regarding the childfree phenomenon, thus these views are reviewed and analyzed using the theories of sociology of law and maqāṣid syarī’ah. The data analysis method used is qualitative with a inductive method. Furthermore, data collection methods involve interviews and documentation. The research findings regarding the views of the National Population and Family Planning Board of the Special Region of Yogyakarta on the childfree phenomenon are divided into three conclusions. Firstly, the findings show that all three informants from the National Population and Family Planning Board of the Special Region of Yogyakarta as a whole disagree with the childfree phenomenon because it is not recommended. The reason is that there are more negative impacts than positive impacts associated with it. Secondly, the analysis of the sociology of law towards the views of the National Population and Family Planning Board of the Special Region of Yogyakarta on the childfree phenomenon indicates that it is recommended because the purpose of marriage is to continue the lineage, which contradicts the principle of being childfree. Various reasons for its non-recommendation include the absence of future generations, lack of welfare in old age, and Indonesian social and cultural views that have not fully accepted childfree as it is considered a violation of social and cultural norms. Thirdly, the analysis of maqāṣid syarī’ah towards the views of the National Population and Family Planning Board of the Special Region of Yogyakarta on the childfree phenomenon also indicates that it is recommended. Islam strongly emphasizes the continuation of progeny. This is because humans can preserve their lineage and ensure the survival of humanity (ḥifẓ an-nasl).
