Abstract

Affirmative action is a policy made with the aim of ensuring that certain groups or groups obtain equal opportunities with other groups or groups in the same field in the political context, affirmative action is carried out to encourage the number of women in legislative institutions to be more representative. General Election Commission Regulation Number 10 of 2023 concerning Nomination of Members of the DPR, Provincial DPRD, Regency/City DPRD Concerning the requirements for submitting prospective candidates in Article 8 paragraph (1). In terms of this policy, the author will raise the issue of how effective compliance is affirmative action in the nomination of legislative members in Banyumas Regency according to PKPU Number 10 of 2023. Apart from that, the research also discusses the review political jurisprudence towards fulfilment affirmative action in PKPU Number 10 of 2023. To find out the answer to the problem formulation, this research used a type of field research (field research) namely conducting observations and interviews at the Banyumas Regency KPU Office and related Political Party Offices, in descriptive-analytic form with a juridical-empirical approach. The theoretical framework in this research uses theoretical studies of legal effectiveness, gender equality, and political jurisprudence. The results of this research show that the candidacy for legislative members in Banyumas Regency as a whole has not met 30% female representation. This research found that, in the context of legislative candidacy in the 2024 elections in the Banyumas DPRD, of the 18 political parties there is one political party that has not fulfilled or implemented affirmative action 30% quota as stated in KPU Regulation no. 10 of 2023, namely the Crescent Star Party which only has 25% female representation. This shows that affirmative action in Banyumas Regency is not effective. In political jurisprudence Women's leadership is permitted provided that the woman is competent or able both physically and spiritually. This shows that affirmative action does not contradict fiqh siyasah.
