Abstract

Tiktok shop is a new feature that is different from e-commerce platforms in general. However, the TikTok shop feature offers big discounts on the prices of the products offered. In fact, it tends to be lower than other e-commerce or offline stores and does not have permission to operate on e-commerce platforms. This has the potential to cause predatory pricing in the world of business competition. With a situation like this, many MSMEs in Indonesian markets are experiencing a lack of customers and are unable to compete with trade carried out via e-commerce platforms, especially TikTok Shop. In response to this, the government through the Ministry of Trade has issued Minister of Trade Regulation (Permendag) Number 31 of 2023 (a revision of Minister of Trade Regulation Number 20 of 2020) and aims to support micro, small and medium enterprises (MSMEs) as well as business entities that operate commercially through electronic system (PMSE) in the country. The type of research used is field research which uses a normative-empirical approach. The main data source in this research is the results of direct interviews with Yogyakarta City MSME actors, then supported by literature or literacy related to this research, and documented according to the research object. This research shows that Minister of Trade Regulation (Permendag) Number 31 of 2023 is in line with and supports the realization of economic policy objectives. Minister of Trade Regulation Number 31 of 2023 is also in accordance with the contents of the principles of Sharia Economic Law (Muamalah). With the ratification of Minister of Trade Regulation No. 31 of 2023, the economic conditions of Yogyakarta City MSMEs can gradually recover and prevent unhealthy business competition such as below standard prices, less than maximum restrictions on imported goods, and first hand sellers becoming involved in e-commerce competition.
