Abstract

The Indonesian government has issued Law Number 33 of 2014 concerning Halal Product Guarantees (UU-JPH) as a legal umbrella for Muslims when consuming food. The JPH Law contains halal certification obligations that must be carried out by all business actors. However, there are several parties who state that this decision is burdensome for MSEs, considering that the income of MSEs is still far below the average. In response to this, the government issued Minister of Religion Regulation Number 20 of 2021 concerning Halal Certification for MSEs with the aim that all MSEs can implement halal certification without having to be burdened with the costs of producing it. However, after the publication of this regulation, it is not yet known whether the regulation has really been implemented and brought benefits to MSEs or vice versa. This research is field research with an empirical juridical approach. This research is descriptive analytical, namely a method that describes or provides an overview of an event that is occurring in society, then analyzed using maṡlaḥaḥ theory. Data collection in this research used several techniques, namely observation, interviews and documentation. Based on research results, the implementation of PMA Number 02 of 0202 concerning Halal Certification for MSEs in Bantul with 4selected sub-districts, has a high number of halal certifications, however, based on the high number of halal certifications, there are still areas that have not implemented halal certification. Pleret, Wonokromo, and Trimulyo Districts, the majority of MSEs have implemented halal certification, although there are several MSEs who are still in the process of making halal certificates, this happens because of halal education, high legal awareness, ease of business licensing, and keeping up with current developments. . Meanwhile, in Sabdodadi District and Imogiri District, at the time of the research, no MSEs were found to be implementing halal certificates, meaning that in these areas the implementation of halal certification was still uneven, this was due to a lack of halal education and socialization, low legal awareness and low halal literacy of MSEs. and the existence of halal confidence among MSEs in the products they buy and sell. The implementation of PMA Number 02of 0202is included in maṡlaḥaḥ mu'tabarah and in terms of the strength of its substance it is categorized at the level of maṡlaḥaḥ ḍarūrīyah, because by implementing free halal certification based on halal statements from MSE actors (self-declaration), MSE actors can provide certainty of the halalness of the products they produce. sold, so that Muslims can consume food according to Allah's commands and can avoid matters that are syubhat (vague circumstances regarding the halal or unlawfulness of something).
