Abstract

Engagement is the initial step towards marriage. Engagements are conducted in various ways according to the customary practices prevailing in the community. The purpose of engagement is to get to know each other and each other's families. In this case, the community of East Duko Village has a custom or tradition called the salenan tradition. This tradition requires the man who has engaged to give salenan (clothing) and petra (zakat al-fitr) to the woman he is engaged to. Unlike the man's engagement, the woman's engagement only requires her to deliver iftar meals to the man she is engaged to. The existence of this salenan tradition certainly has good meanings and functions. Looking at this portrait, the focus of this research is: first, why the community of East Duko Village still adheres to the tradition of salenan. Second, what is the function of the salenan tradition during the engagement period in East Duko Village. This study will use the functionalism theory of Bronislaw Malinowski and the maqāṣid syarī'ah theory of asy-Syātibī with field research methods using the approach of Islamic legal anthropology research. The research results show that the reasons the community of East Duko Village still adheres to the salenan tradition are: first, to preserve the traditions and cultural heritage of ancestors because previous generations did things with caution and contained many good meanings, such as the values of acquaintance, responsibility, and charity. Second, to avoid social sanctions, as they will be gossiped about for not adhering to the ancestral heritage, which will lead to disharmony between the two families and their relationships with neighbors because this tradition is a code of conduct that is paramount in behavior. Third, to avoid engagement breakups, because if their relationship is not good, it will ultimately lead to the breakup of the engagement and even the severing of ties. The function of the salenan tradition in Malinowski's functionalism theory is to satisfy psychobiological needs in the form of basic human needs. The salenan tradition provides comfort because it eliminates worries about engagement relationships, thus ensuring that reproductive needs will be met. The salenan tradition also serves instrumental structural needs such as law and education. This tradition meets the need for certainty in the continuity of relationships and fulfills the learning of responsibility. The salenan tradition also serves integrative needs such as religion and art. This tradition fulfills the need for blessings from God. The salenan tradition, when viewed from the perspective of the maqāṣid syarī'ah of asy-Syātibī, can be concluded that this tradition is an effort to preserve offspring (ḥifẓu an-nasl). This tradition is an effort to maintain harmony in the household when heading towards marriage so that the goals of marriage can be achieved. This tradition falls under the category of hājiyat in the hierarchy of maqāṣid syarī'ah. Because if this tradition is not followed, it does not directly damage relationships but only creates difficulties.
