Abstract

This research discusses the effectiveness of the implementation of Law Number 16 of 2019 regarding the age limit for marriage in preventing early marriage in Bolo District. Regulations regarding the age limit for marriage have been regulated in Law Number 16 of 2019, namely that marriage is only permitted if the man and woman have reached the age of 19 (nineteen) years. This regulation was passed on October 14 2019 and began to be promulgated on October 15 2019. This regulation aims to get better marriages and thus get better offspring. Regulations regarding the age limit for marriage are not binding so that teenagers who wish to marry under age can apply for a marriage dispensation as regulated in Law Number 16 of 2019 Article 7 Paragraph (2) which explains that a marriage dispensation can be applied for by parents if something happens. who presses against his child. This research will analyze early marriages that occur in Bolo District and then relate it to the effectiveness of the implementation of Law Number 16 of 2019 concerning the age limit for marriage in the Bolo District community. This type of research is field research. This research uses a sociological approach to Islamic law and the theories used are Atho Mudzhar's sociological theory of Islamic law and Soerjono Soekanto's theory of legal effectiveness. Data collection techniques in this research are through observation, interviews and documentation. The data analysis method used is inductive analysis. The results of this research are the factors that influence the occurrence of early marriage in Bolo District, namely promiscuity, economics, lack of religious and family education. Then the implementation of Law Number 16 of 2019 concerning the age limit for marriage to prevent early marriage in Bolo District is not effective because of the 5 factors to see the effectiveness of the implementation of a law initiated by Soerjono Soekanto, some are not fulfilled, namely the law enforcement factor, the law enforcement facilities and community factors.
