Abstract

Gold investment is no longer something foreign among Indonesians. Therefore, legal protection is needed for every investor. No exception to the gold investment in the form of Gold Savings at PT Pegadaian Unit Helper Branch (UPC) Prambanan. The first discussion will discuss the form of legal protection of Gold Savings investors from gold investment losses at PT Pegadaian UPC Prambanan Office. Furthermore, the second discussion is about the obstacles experienced by PT Pegadaian UPC Prambanan Office when implementing legal protection for Gold Savings investors at PT Pegadaian UPC Prambanan Office. Financial Services Authority Regulation (POJK) Number 6/POJK.07/2022 concerning Consumer and Community Protection in the Financial Services Sector is the main basis for this research. The type of research used in this research is field research with the nature of the research is dexirptive-qualitative. The approach in this research uses an empirical approach. The data analysis method uses qualitative. And the data collection method uses interviews, observation, and documentation. The theories used are legal protection theory, agreement theory and investment theory. The results showed that: First, the form of legal protection provided by PT Pegadaian UPC Prambanan takes the form of three protections, namely preventive legal protection, repressive legal protection and legal protection through an agreement between Pegadaian UPC Prambanan and investors. The three protections provided by PT Pegadaian UPC Prambanan are in accordance with the Financial Services Authority Regulation (POJK) Number 6/POJK.07/2022 concerning Consumer and Community Protection in the Financial Services Sector. Second, in the implementation process there are obstacles such as the lack of understanding of investors of their rights and obligations as investors which can lead to differences in understanding between PT Pegadaian and investors. Another obstacle is the lack of accuracy of investors in reading and understanding the 21 articles of the agreement between PT. Pegadaian and Investors which can also result in a dispute.
