Abstract
Intellectual property encompasses human knowledge, creativity, innovation, and expression that have evolved alongside civilization. Intellectual Property Rights (IPR) provide legal protection for creative outputs such as Copyright, Patents, Trademarks, Trade Secrets, and Industrial Designs. In the digital era, artworks can be digitized and sold as Non-Fungible Tokens (NFTs) on platforms like OpenSea and Toko Mall, utilizing blockchain technology to record ownership and facilitate peer-to-peer transactions. NFT technology promises breakthroughs in copyright protection by granting royalties to the original creators and ensuring ownership through a smart contract system. However, challenges arise when registered works belong to others, resulting in copyright infringements that harm the original creators. Cases of NFT copyright infringements, such as those involving Imelda Victoria Nauli Hutabarat and Kendra Ahimsa, highlight the need for more effective legal protection and stricter enforcement. This study examines legal protection against copyright infringements on artworks converted into NFTs from the perspective of intellectual property law in Indonesia, aiming to understand legal protections and the responsibilities of violators for copyright violations on Non-Fungible Tokens. This research is a normative juridical study with a conceptual and legislative approach. The data analysis method used is descriptive-analytical. Data collection methods include interviews and literature review. In analyzing these issues, this study will use the theory of legal protection and the theory of liability. Currently, legal protection in Indonesia does not specifically regulate copyright infringements of paintings in the NFT medium, with additional challenges arising from the immutable and pseudonymous nature of blockchain systems, making it difficult to identify offenders. Although creators' rights and paintings as creations are still protected under the Copyright Act, legal responsibilities of copyright violators, according to the Copyright Act and the Civil Code, include compensation to the victims. Based on the theory of Strict Liability, offenders must bear legal consequences even if the infringement was unintentional, as they are deemed to have failed to exercise the required legal caution.
