Abstract

Law no. 1 of 2019 concerning Marriage provides a limit regarding the age of marriage for both men and women, namely 19 years. However, in Cilongok Subdistrict there were 47 cases of applications for marriage dispensation due to being underage and this was included in the highest number of applications for marriage dispensation in Banyumas Regency in 2022. Of the 47 cases in Cilongok subdistrict, 9 cases occurred in Cilongok village which was the largest number of cases. in villages throughout Cilongok sub-district. From these 9 cases, the author wants to know more about the reasons and factors that influence parents to give marriage permission to their underage children. The type of research used is field research, using a Normative Juridical approach method, based on statutory regulations and several legal rules. The data collection technique is using interviews. The theories used here are the sociological theory of law and Maslow's hierarchy of needs theory. The results of this research are that many parents think that the only way for children to be happy is to get married even though they are still underage, consideration of prospective husbands who are already working, and their own children's willingness to marry makes parents more confident that their children will live happily. in marriage. The factor that influences parents in giving reasons is a lack of knowledge about the impact of underage marriage
