Abstract

This research compares the legislative authority between bicameral parliaments in Indonesia, the Netherlands and the United States from the perspective of Maslahah Murlah. Using comparative methods, this research analyzes the structure and function of legislative institutions in the context of community interests. This research shows differences in the mechanisms for forming laws, the division of authority between the two chambers, and the role and function of legislative committees. The method used is qualitative research with a juridical-normative approach, namely through analysis of theories, legal principles, cases, and legislation relating to the bicameral parliament. This research uses the theory of the effectiveness of parliamentary functions and the Mashlahah Murlah theory to assess the role of the government in implementing legislative authority in the bicameral parliament. From the perspective of maslahah murlah, the legislative authority of the bicameral parliament in the three countries seeks to achieve the public benefit by paying attention to the interests of the people. Although there are challenges and structural differences in each country, the main focus in the legislative process remains on social justice, people's welfare, and the protection of individual rights. The United States is considered to uphold the highest level of benefit because in its legislative values it prioritizes the principle of balanced power with a strict system of checks and balances and indicators of popular sovereignty. Based on the theory of the effectiveness of parliamentary functions, United States legislation is ranked highest because the legislative process is very democratic and upholds regional representation
