Abstract

The practice of sand and stone mining in Sukorini Village, Manisrenggo Subdistrict, is carried out by a group of people, the majority of whom are local villagers, where the practice does not have an official permit from the government. Based on Law Number 4 of 2009, every mining business should have a Mining Business Licence (IUP). As a result, mine owners become negligent so that work accidents often occur, due to the absence of good work safety SOPs in accordance with Law Number 1 of 1970 concerning Work Safety. The majority of people know that mining is illegal. However, why is there still a lot of illegal mining in Sukorini Village and how does illegal mining correlate with the risk of work accidents? This type of research is field research with qualitative methods. Meanwhile, the nature of this preparation is descriptive-analytical with a juridical-sociological approach, meaning that the approach is based on binding norms or regulations and examines problem factors with a sociological approach. While in collecting data, the compiler uses 2 stages, namely: First, collecting data from primary, secondary and tertiary legal sources related to this preparation. Second, collecting primary data and informants through observation, interviews and documentation. The results of the study show that the law on mining legality has been well regulated, but the problem of illegal sand and stone mining is constrained by the indecisiveness of law enforcement officials and local governments in enforcing illegal mining laws. In addition to the lack of law enforcement, illegal mining in Sukorini Village is constrained by economic, educational and legal culture factors that have become local customs. The impact of illegal sand and stone mining is the greater risk of work accidents on mining workers, even though Law Number 1 of 1970 states that occupational health and safety is the right of all workers. Therefore, it is necessary to be firm in law enforcement against illegal sand and stone mining for the safety of mining workers and for the common good.
