Abstract

In January 2023, the public was shocked by the ratification of law number 1 of 2023 concerning the new Criminal Code. There is one controversial article, namely article 603, where the minimum sentence for perpetrators of corruption is only 2 years. These rules are lower compared to the rules in the previous Corruption Law. Departing from this problem, the author is interested in researching further whether these regulations provide a sufficient deterrent effect and conflict with maqashid sharia. In this research, the author used the library method. After research, the punishment provisions for perpetrators of corruption in the new Criminal Code do not provide a sufficient deterrent effect and are not in accordance with the objectives of punishment in Islamic criminal law (fiqh jinayah), and are contrary to the objectives of protecting the five (religion, soul, reason, lineage and property) in maqashid sharia. As for suggestions for future improvements, the legislators (DPR) and the government must be very careful in drafting a law before it is enacted and implemented so that it does not have a massive negative impact and is detrimental to the interests of society, the nation and the state more broadly.
