Abstract

Local government in Indonesia is regulated by various laws and regulations that aim to create efficient, transparent and accountable governance. One of them is regarding the affixing of hierarchical signatures on Service Manuscripts signed by the Regional Head, Deputy Regional Head, and other officials. Article 40 Paragraph (2) of Permendagri No. 1 of 2023 regulates the procedure, limiting the affixing of initials by a maximum of three officials in stages. This rule is designed to ensure good governance and transparent decision-making. However, in practice, challenges and obstacles often arise in the field. One case that attracted attention was related to a circular letter issued by the Regent of Tanah Datar District. Tanah Datar District was chosen as a case study because this incident arose amidst the government's efforts to improve local governance. This incident reflects the gap between central regulations and their implementation at the regional level. This type of research is field research (Field Research) with an empirical juridical approach. The approach that the author uses is empirical juridical, which is different from policy products such as Circular Letters issued by the Regent Number 100.3.4.2/885/ORG-2023 concerning the Implementation of Office Manuscript Guidelines within the Government of Tanah Datar Regency, which is the primary data in this study related to conflicts of authority between the Regent and Deputy Regent and their implications for the principles of Good Governance. The data analysis technique in this thesis uses qualitative research methods with deductive analysis, and involves observation, interviews, and documentation methods. Secondary data was obtained from various additional sources. This research was conducted at the Tanah Datar Regency Government Office and the Marawa Law Institute Office as research subjects.
