Abstract

The emergence of intermediaries in the midst of modern society today is urgently needed to facilitate a business. The practice of intermediaries or brokers has existed since the time of the Prophet Muhammad (peace be upon him) called Samsarah, which is an intermediary trader whose function is to sell other people's goods by taking wages without taking risks, in other words an intermediary (simsar) is an intermediary between sellers and buyers to facilitate buying and selling. However, in practice, sales and purchase contracts involving intermediaries often occur things that are not in accordance with the existing provisions (Islamic law) such as leaving the role of intermediaries/simsar. From this, the author's interest arises to study more deeply, which in this study discusses intermediaries in buying and selling property on the Instagram account @aa.propertijogja. This study aims to find out 1). What is the practice of buying and selling property with an intermediary system on the Instagram account @aa.propertijogja? 2). How is the practice of buying and selling property with an intermediary system on the @aa.propertijogja Instagram account reviewed from Islamic law? This research is a field research using a descriptive method of analysis with a qualitative approach. The data source of this research consists of primary data, namely interviews, and secondary data, namely data from journals, books, articles, related to the problem being researched. The data collection techniques in this study are participant observation, interviews, and documentation. The results of the study show that, the practice of buying and selling property through intermediaries in its implementation in general is good, such as the intermediary @aa.propertyijogja in the sale and purchase contract and the agreement on commission wages are in accordance with the applicable provisions (Islamic Law), although there is one case where the role of simsar is abandoned by the seller and buyer who even though the meeting between the seller and the buyer is on the services of simsar, So that from this from the contract that was originally good to be damaged/canceled where there is a party that is disadvantaged in this case is the intermediary @aa.Propertijogja.
