Abstract

Music concerts have become one of the entertainment business sectors that people are interested in because of developments over time. Music concert performances involve concert audiences as consumers and promoters as business actors. The involvement of concert audiences and promoters occurs because of the relationship pattern of sales and purchase agreements. A concert ticket is an object resulting from a buying and selling transaction between concert goers and promoters which is proof of purchase or a sign that concert goers as consumers have the right to attend the concert. The agreement used in concert ticket transactions between both parties is generally a written agreement. The written agreements that are often found in concert ticket sale and purchase agreement transaction patterns are agreements that are in standard form (Standardized Contract). However, standard clauses in agreements can become a shield as well as a weapon for business actors to gain profits for themselves. Therefore, the author is interested in conducting research on the application of consumer protection provisions to the standard clauses for Nicole Niki World Tour 2023 concert tickets and the legal remedies that can be taken when finding standard clauses that do not comply with the provisions. The type of research used by the author is empirical normative research. This research was carried out using field research and library research. In the data collection method the author used the interview method and reviewed documents and literature related to agreements and consumer protection. The research results show that: First, business actors or promoters include standard clauses that are not in accordance with statutory provisions. Business actors do not carry out the agreements agreed in the standard clauses. Consumers have the right to receive full responsibility from business actors if the concert is canceled. Second, legal remedies that can be taken by consumers when they find standard clauses that are not in accordance with legislation can be taken by means of litigation or non-litigation. Resolving non-litigation consumer disputes can be done through mediation, conciliation or arbitration according to the agreement of the parties.
