Abstract
Bartering new rice with old rice is a muamalah practice that is still practiced by the community, especially farmers and rice collectors. However, in terms of practice, the barter trade is identified as riba fadhl, because there are differences in the size and value of the goods exchanged, resulting in a difference in the value of the goods exchanged. Barter that is allowed in Islam is goods that must be of the same type, the same value, and take place immediately. However, in the reality of daily life, there are still many farmers and rice collectors who still carry out rice barter transactions. Departing from this phenomenon, the authors are interested in examining more deeply the sociological-normative review of the barter sale of new rice with old rice that occurs in the community. The reason why the practice of bartering new rice with old rice is still carried out and how the sociological-normative review of the practice of bartering rice carried out by the community. This type of research is field research. With a sociological-normative approach, more specifically utilizing sociological studies, namely structuration theory and also normative studies, namely al-‘urf. While the data analysis method used is descriptive qualitative. In the data collection method, the authors used observation, interviews, and documentation. The results of this study show that the barter trade of new rice with old rice carried out by the community contains elements of usury. However, the practice of bartering rice is still carried out because one of the reasons is due to the negligence of the government as (structure) here, namely the government at a macro level cannot supply and fulfill the food needs of its people (agent). Secondly, nutritionists and religious leaders rarely provide health enlightenment and religious law, so that this phenomenon can occur. The social fact that emerges in the community is that because the state has not been able to fulfill food sufficiency, they have no other choice to barter new rice with old rice. However, the practice of bartering rice like this is not allowed in Islam, because the practice contains elements of usury. The reason it is still being done is because of ignorance of the law of buying and selling berter and being hit by economic circumstances, so they ignore Islamic law, and in the frame of Islamic law this can be said to be al-'urf al-fasid.
