Abstract

Currently, precisely in Rubaru Village, Rubaru District, Sumenep Regency has experienced a vacancy, in the government system if there is a vacancy in a government, the local sub-district head/regent is obliged to find a replacement for the village head leader when there is a vacancy. The vacancy began with a dispute in the results of the village head election, the simultaneous elections on April 22, 2022 in Rubaru village, Rubaru District, Sumenep Regency, from one of the cakades sued for fraud committed by one of his rival cakades who had passed away before the implementation of the village head election and managed to excel in the vote provocation, which eventually resulted in the Regent of Sumenep appointing PJ as a replacement until the implementation of the next regional elections. This is a concern for researchers, so the researcher conducted a study on the Juridical Study of Disputes over the Results of the Village Head Election (Case Study in Rubaru Village, Rubaru District, Sumenep Regency). This research is included in qualitative research with a juridical-empirical approach. Research data collection techniques are sourced from interviews, observations, and documentation. The data analysis used is a qualitative descriptive method where the author combines two primary data obtained in the field, compiled, described, and explained in a systematic, logical, efficient, and effective manner. The theories used are the theory of democratic legislation, and the theory of Siyasah Syar'iyah. Based on the results of the study, it was determined that the procedure for the implementation of the village head election in Rubaru Village, Rubaru District, Sumenep Regency in 2021 was in accordance with Law Number 6 of 2014 concerning Villages. The settlement of disputes over the results of the village head election in Rubaru Village from the perspective of Siyasah Syar'iyah is ideal. This is evidenced by the decision of the Surabaya Administrative Court in reviewing and deciding disputes based on the main function of the judiciary and reflecting the role of Siyasah Qadha'iyah.
